| Dilemma over claiming candidate |

I've never had this happen, so I'm not sure what to do.
I was working with a client recently on a vacancy and have emails to state that they wanted me to source candidates for a role, along with one other agency.
I submitted 4 CV's. 3 of the candidates were interviewed, 1 was rejected.
The client was not happy with any of the 3 and decided to rejig the department, creating 2 lower level roles.
I recently emailed to say 'will you reconsider the candidate who you originally rejected now that the role is a lower level?' only to be told that they had taken her on the day before.
They have basically said that it's an entirely different role, the first role was closed and the second role was dealt with by another person in HR, so they are not due to pay a fee.
The REC have said that they are and I know that they are, but what are people's thoughts on this. I actually think they have made a genuine mistake and think that an introduction is per job, despite having terms. However, that's not really my problem is it? I've done my job, issued them terms - this isn't the first time I've recruited for them.
They have a high turnover of staff and 75% of registered candidates don't want to work there. It's not a company I am bothered about doing business with, but I also don't want it to become known that we're an agency that takes clients down the legal route. However, they clearly are due to pay a fee.
Not sure what to do and no-one to bounce ideas around with. |

I have raised it and they fully understand, but their manager is saying they think there is no fee due as 2 roles were being dealt with.
I have decided to pursue it after talking to the REC and yes, it's their standard terms. I'm in no doubt that I'm due a fee, but was just concerned about the repurcussions, but really I don't think I want to do business with a company that might do this again. |
